ضرورة عسكريّة

في أوقات النزاع، تعرف الضرورة العسكرية على أنها المفهوم الذي يستخدم لتبرير اللجوء إلى العنف. ويحظر قانون النزاع المسلح أي عنف أو تدمير لا تبرّره الضرورة العسكرية. ولا يكون استعمال القوة المسلحة مشروعًا إلا عند محاولة تحقيق أهداف عسكرية محدّدة، وبشرط أن يبقى ضمن إطار مبدأ التناسب.

وعلى العكس من ذلك، يمكن أن يستخدم هذا المفهوم للطعن في استخدام القوة المسلحة إذا ما بدا أن العنف والتدمير كانا:

—غير ضروريين - حيث لم يرتبط الهدف أو الضحايا بهدف عسكري محدّد؛

—غير متناسبين - لم تكن الميزة العسكرية متناسبة مع الأضرار المصاحبة التي تصيب المدنيين؛

—عشوائيين - الهجوم لم يميّز بين الأهداف العسكرية والأعيان المدنية؛

—يهدفان إلى نشر الرعب بين السكان المدنيين.
